Noam says South Africa ‘should be told enough is enough’, not Israel

The Israeli lawyer has accused South Africa of distorting facts about what is happening in Gaza, making “outlandish accusations” against Israel.

“Perhaps most repugnant is South Africa’s suggestion that Israel has created zones of extermination, evoking terminology reminiscent of the systematic extermination of European Jews during the Holocaust,” Noam says, adding that South Africa’s claims that Israel has closed critical border crossings to Gaza are “blatantly untrue”.

“Like many of the claims in South Africa’s application and requests, they lack any basis in fact or law,” he argues.

“If anybody should be told that enough is enough, it is truly South Africa and not Israel,” he says. “At what point do we say enough to South Africa’s repeated attempts to exploit the provisional measure procedure of this court in such a vile and cynical manner?”

Noam is arguing that Israel’s law enforcement authorities have acted to counter Israeli protesters blocking aid and have coordinated the passage of aid trucks.

As part of the “lessons learned”, an improved mechanism was adopted to ensure the safety of the convoys, he says.

“Israel will continue to ensure the effective and efficient transfer of humanitarian aid,” Noam adds.

Israel also has a “robust and independent” legal system that enables those who seek to challenge its actions to do so domestically. Israel’s High Court of Justice, for instance, is reviewing a petition submitted by humanitarian NGOs to review its compliance with humanitarian policies in Gaza.

Israel has repeatedly been accused by aid groups and humanitarian agencies of “deliberately” blocking aid supplies heading into Gaza and obstructing the humanitarian response in the besieged and bombarded territory.
